Mr. Mmembe is currently on Police bond after he was arrested on 9th April, 2023 for unlawfully discharging a firearm during the by-election process in Serenje District of Central Province.

And, on Friday April 14th 2023, during the swearing in of the New Inspector General of Police, Graphel Musamba, President Hakainde Hichilema instructed the police to clean out illegal guns, citing that, no one should go around discharging live ammunition.

Meanwhile, reacting via a statement issued to Mafken FM Radio, Dr. MMembe says it is lawful for any Zambian to own and carry a licensed firearm and use it within legally permissible conditions and circumstances.

The Opposition Leader adds that, in a more fair and just society President Hichilemas comments and insinuations would constitute a very serious breach, in that, it is prejudicing his case.

Mr Mmembe further states that, from his comments and insinuations it is very clear that, the head of state is very excited about the case and would like to see him fixed.
